Compassionate and Responsive Representation

As parents, you want what is in the best interests of your children — you also want to maintain a meaningful role in your child's growth and development. Child custody and visitation matters can be contentious. You need a lawyer who understands the emotional challenges you face, one with the compassion and experience to address your needs, but one you can rely on to fiercely fight for you.

You also want an attorney you can rely on to advocate for you, to make sure your role as a parent isn't diminished just because you're no longer with the other parent, so you have the best possible outcome.

At the Law Offices of Linda J. Claypool, our office is dedicated to family law matters. Child custody and visitation is one of the primary areas that we handle. Ensuring that you have competent counsel is critical, most especially in the often delicate area of determining what is best for your children.

During your first consultation, which is free of charge, we will

review your case with you and summarize its strengths and weaknesses.

Three kids with white backgroundWhat The Court Process Usually Involves

In California, child custody is based on the 'best interests' of the child. If the two parties in a divorce cannot agree on a child custody arrangement, they will be ordered to mediation to try and resolve the issue. If your child custody dispute cannot be resolved through mediation, the court will issue a temporary child custody order based on the recommendations of the mediator. You and your spouse have a right to a child custody trial before the court will issue a final order.

In determining who will have primary physical custody of the children, another factor the court considers is which parent is more likely to allow frequent and continuing contact with the other parent.

What does the court mean, though, when they refer to the 'best interests' of the children? Even as a parent, oftentimes it is difficult to understand what exactly the court is looking at and how they make that determination. That's where having an experienced attorney, one who's also familiar with our local courts, can make all the difference.

Linda J. Claypool is thoroughly familiar with California State family law.

Our Child Custody and Visitation Practice

We work with both mothers and fathers, helping to establish and implement parenting plans that are in the best interests of your children, while ensuring your rights as a parent are protected. We will advise you at all stages of your child custody or visitation matter, from the establishment of temporary pendente lite orders through post-judgment requests to modify or enforce existing custody and visitation orders.

  • Paternity actions: If you're not married to the other parent of your child, your rights relating to child custody, visitation, child support, birth-related expenses, medical and dental expenses for your child or children are all matters that the Court can address in a parentage action. You and your children have rights. We can help you get the orders you need to protect those rights.
  • Domestic Violence and Restraining Order matters: When there are issues or allegations of abuse, and there are children involved, the Court will also need to address custody and visitation of those children. We can help you to seek or contest a request for restraining orders.

We will be your strong advocate in court and negotiations, as well as

your approachable counsel, advising you of your options and likelihood of success.
